Is Kratom Legal?

These leaves, related to those of the coffee plant, are a natural herbal remedy that can be used for pain relief, mood boosting, immune system stimulation stimulation, energy boosting, and as a natural aid to opiate addiction in some cases and on the right dosages.

Research into the benefits and risks of Kratom is still ongoing, but the current indication is that the benefits are significant, with the above being only a few of the most common positive effects of Kratom leaves. There are many other benefits possible from this natural herbal remedy, but they are not recognized by all those in positions of legal power. As such, it is important to be aware of the legality of Kratom in your particular local area.

Is Kratom legal in the USA?

The legal status of Kratom in the USA varies between different states, with it being fully legal in some states, controlled in others, and entirely illegal in a handful. A few years ago, the DEA classified Kratom as a “substance of concern,” due to uncertainty over its effects. This is common for market-ready stimulants; early in their availability, they are often classified as concerning due to a lack of research into their effects. Since then, the research has been developed much further, and there is no evidence that Kratom has problematic side effects beyond those of caffeine. Most states now classify Kratom as a food product, although there are still a few that impose legal restrictions on the sale and use of this herbal remedy even on buying Kratom from online selling platforms.

In most states of the US, Kratom is entirely legal, although there are a number of specific cities and counties within these states in which use and possession are banned or otherwise controlled.

The six states of the USA in which Kratom is entirely illegal for use, possession, and purchase are Alabama, Arkansas, Indiana, Rhode Island, Vermont, and Wisconsin. These are the only states in which all Kratom related matters are illegal; other states have variable restrictions, but not full illegality.

In Illinois and New Hampshire, Kratom is legal for use by anyone above the age of 18, apart from in Jerseyville, IL, in which Kratom is banned.

In California, Kratom is legal everywhere except for the city of San Diego, in which it is banned. Similarly, it is legal in Florida apart from a ban in Sarasota County, and legal in Mississippi apart from Union County, in which it is banned.

Colorado follows a similar system, with Kratom being legal in most places aside from Denver, where it is banned for “human consumption,” meaning that it can still be sold as a non-food product such as incense.

Kratom has recently been legalized in Tennessee and is now legal for use by anyone over the age of 21.

In all other states, Kratom is entirely legal as of 2020.

Is Kratom legal in Asia?

There are many Asian countries with diverse legal systems, but a few of them place strict restrictions on the use of Kratom. In Israel, Japan, Myanmar, Malaysia (Green Malay strains), Singapore, South Korea, and Vietnam, Kratom is entirely illegal.

In Thailand, the growing of Kratom is currently banned. Kratom is classified as a Category 5 substance in Thailand, much like Marijuana, and is undergoing current review as to regulation thanks to changing understanding of the medicinal value of these plants. As of the start of 2020, both Kratom and Marijuana are legal for potential medical usage, although growing Kratom is still illegal.

In China, Kratom is definitely legal in Hong Kong, and there appears to be no clear legislation surrounding its legality in the rest of the country. Information is sparse, but it appears to be legal as far as we can tell.

Is Kratom legal in Australia and New Zealand?

In Australia, Kratom is entirely illegal to grow, use, possess, or purchase in every way. In New Zealand, however, Kratom is classified as a Schedule 1 substance. This means that it is illegal to import or export, but it can be prescribed medically by a doctor in some certain situations. In most situations in New Zealand, however, it is illegal or at least very tightly controlled.

Is Kratom legal in Europe?

In most European countries, all Kratom strains appears to be illegal, or at least not completely illegal. Local legislation on use and purchase of Kratom may be worth checking for Ireland, the United Kingdom, and Italy, however.

Kratom is illegal for both purchase and use across Denmark, Finland, Latvia, Lithuania, Poland, Romania, Russia, and Sweden. All other European countries, however, are less restrictive, and Kratom should be legal in some form, even if not readily available.

Is Kratom legal in Canada?

Canadian legislation with regards to Kratom is very similar to that of Denver, Colorado. This law states that Kratom is illegal for “human consumption,” meaning that it cannot be sold as a foodstuff. It is, however, still available for use as an incense or other non-consumable options. This does not prevent Kratom purchased as incense from being misappropriated and used for human consumption in private, but the law states that it is not for this purpose.
